Court orders new electoral panel for Amosu vs.Governor Gbenga Daniel

April 04, 2009 By: Babalola Category: Ogun State

A federal Court of Appeal in Ibadan last Thursday directed the President of Court of Appeal to constitute a fresh panel for the retrial of election petition brought by Action Congress’s Ibikunle Amosu against the election of Gbenga Daniel as Ogun state Governor in the 2007 elections

The court dismissed an application filed by Governor Gbenga Daniel seeking an order to restrain the President of Court of Appeal from constituting a panel for retrial of Senator Amosu’s petition.

A Nigeria court had earlier directed the President of the Court of Appeal to constitute another electoral tribunal to trial the petition filled by Amosu against Governor Daniel’s victory, because the first election tribunal constituted was accused of bias

Gbenga Daniel wins, Aregbesola’s case for retrial

Governor Gbenga Daniel

A Federal Court of Appeal sitting in Ibadan on Monday quashed the verdict of Osun state Election petition Tribunal that confirmed the election of Prince Olagunsoye Oyinlola as the Osun state Governor just as the same court upheld the election of Otunba Gbenga Daniel as the Ogun state Governor.

Delivering judgement on the Osun case, the Jugdes unamimously  blamed the state election Tribunal for  miscarriage of justice.

Nullifying the judgment of the lower, the President Judge of the Appeal court, Justice Omage said that the President of Appeal Court should constitute a new election petition Tribunal  to retry the election petition of Engineer Rafiu Aregbesola, the Action Congress’s Gubernatorial candidate in the 2007 Governorship elections in Osun state.

The Petitioner, Engr. Rafiu Aregbesola went to the court of Appeal after the Election Petition Tribunal last year upheld the election of Oyinlola as the validly elected Governor of Osun State.

Earlier in the day, the Appellate court upheld the judgment of Ogun state Election petition tribunal  that Governor Gbenga Daniel was validly elected, stressing that  the  Petitioner, Otunba Dipo Dina of the Action Congress did not prove cases of electoral mal practices leveled against the PDP and INEC  beyond all reasonable doubt. Holding that the appeal lacked merit
